Do I have any Legal standing in keeping my tenant’s deposit?
My previous tenants are threatening to sue, claiming they are entitled to their deposit.
Here’s the situation:
1. Carpet damaged beyond what would be considered normal wear and tear (1yr)
2. Damage to the walls ( Paint, Nails for pictures)
3. Removal of Light fixtures (Damaged and not put to their original place
4. Oil stains in garage in excess, not cleaned and large amounts of oil still present.
5. Constructed a concrete fixture, barbeque (without permission) in the backyard 4ft wide, 3ft tall, removal is still an unknown expense.
Tenants offered a non legal remedy, to “Help clean up”, however only after they had moved out already (leaving us to pay the mortgage)
At the same time we would like to search for new tenants but cannot while we are still making repairs, in other words we are losing money.
Are they entitled to their deposit?
( I am a San Francisco, CA Landlord)
I also am a landlord, but in WA. state. Do not know what your laws say. But here where I am I would have done a walk through with the new tenant…and in that process the tenant and I would agree on what damage was already there and what was not and pictures would have been taken of everything..and then I and new tenet would have signed the paper and just to play it safe I would have 2 witnesses also at the signing and they also would sign. Did you do those things…If you can prove what you say ….I’d say not only can you keep there deposit, but you can take them to court for the rest of the damages. good luck ….
