Is it legal to incarcerate people in a “smoking” jail?
If a non-smoker is sentenced to spend time in a jail cell that allows indoor smoking, would they have case for cruel and unusual punishment or are rights to be healthy in jail forfeit?
nope you would have no suit if it is a state or federal run facility but if it is a private run facility like they have in ohio you would have a case but here in good ol south cakalaki untill they outlawed smoking in all state facilities they would ave laughed at you…i know i just did a little under 6 years in the state pen and the banned smoking right after i maxed out…DONT SELL DRUGS!!!!!!!!!!!!!!
